Welcome to CACHEMIO (“CacheMio”, “we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of our website, online store, content, features, products and services (collectively, the “Services”). Our store is powered by Shopify.

By visiting or using the Services, you agree to be bound by these Terms and our Privacy Policy and Refund Policy. If you do not agree, please do not use the Services.

Nothing in these Terms affects your statutory consumer rights under applicable law.

The Services are hosted by Shopify (see Section 10 and our Privacy Policy for details).

2) Eligibility & Accounts

You may use the Services only if you are at least the age of majority in your place of residence. The Services are not directed to children.
You are responsible for maintaining the confidentiality of any account credentials and for all activity under your account. Do not share or transfer your account.

3) Products & Natural Materials

We work with premium natural linen. Minor variations in weave, texture, and shade can occur between production batches—this is part of the fabric’s character.
We strive to display colors accurately, but appearance may vary due to device settings. Descriptions and prices may change without notice; we may limit quantities or discontinue items at our discretion.

4) Orders & Acceptance

When you place an order, you make an offer to purchase. We may accept or decline any order at our discretion, including for suspected fraud, bulk/reseller activity, or pricing/stock errors. We may request additional verification before acceptance.
Your order is accepted only when we confirm dispatch. Please review your cart carefully; cancellations may not be possible once processing begins.
Your purchases are subject to our Refund Policy.

Personal use only. You represent that your purchases are for personal/household use, not for resale or export.

Pre-orders/backorders. Estimated ship dates are provided on product pages and may change. We will notify you of material changes or delays.

5) Prices, Taxes & Billing

Prices shown at checkout are the prices in effect at the time of order. Unless stated otherwise:

EU consumer prices are VAT-inclusive.
Shipping, handling, and any duties/taxes for non-EU destinations are extra and displayed or collected as applicable.

You agree to provide current, complete, and accurate billing and shipping information and authorize us (and our payment providers) to charge your selected payment method for all amounts due.

Pricing errors. If we discover a material pricing error after your order, we may cancel and refund the order or contact you for instructions before fulfillment.

6) Shipping & Delivery

Origin. Orders ship from our EU warehouses in Germany and Spain.
Processing. Typical processing time is 1–2 business days (Mon–Fri, excluding EU holidays).
Estimates. Delivery windows shown at checkout are estimates, not guarantees. Carrier delays, customs, weather, and peak seasons may affect timing.
Tracking. You will receive tracking once your order ships. We may split shipments to deliver available items sooner.

Risk of loss & title.

For EU/UK consumer purchases, risk of loss transfers upon delivery to you (or to a carrier you explicitly chose that we did not offer).
For other regions (e.g., US), risk of loss may transfer when the carrier takes possession of the parcel, to the extent permitted by local law.

Failed delivery/returns to sender. If a parcel is returned due to an incorrect address, missed delivery, or refusal, we can reship (additional postage may apply) or refund the item price once it is returned in sellable condition (original shipping is non-refundable unless required by law).

7) Consumer Returns & Right of Withdrawal

We want your CAP to feel like a second skin. If it doesn’t, we offer a 30-day store return window for unused, unwashed items with tags and original packaging, subject to our Refund Policy.

EU/UK right to withdraw (14 days). If you are an EU/UK consumer, you have a legal right to cancel most distance purchases within 14 days of delivery without giving any reason. To exercise this right, email serhii@cachemio.store with your order number and a clear statement of cancellation. We will provide return instructions and the return address:

Unless we state otherwise, you are responsible for the cost of return shipping. We will refund you within 14 days from the day we receive the goods (or proof of return), to your original payment method.
Exclusions: customized/personalized items, gift cards, and items marked Final Sale (statutory rights remain unaffected).

Where our 30-day store policy is more generous than the 14-day legal minimum, the more generous period applies.

8) Intellectual Property & User-Generated Content

All trademarks, logos, text, images, graphics, video, audio, design and arrangement on the Services are owned by CacheMio or our licensors and are protected by applicable laws. You may use the Services for personal, non-commercial purposes only. No license is granted except as expressly set out in these Terms.

UGC / Social tags. By tagging @CacheMio or using #CacheMio, you grant us a non-exclusive, royalty-free, worldwide license to repost your tagged content on our website, emails, and social channels with credit to your handle. You can revoke this license at any time by contacting us, and we will remove future use.

9) Optional Tools & Third-Party Links

We may provide access to tools and content from third parties (e.g., payment processors, shipping carriers, analytics, social networks). These are provided “as is” without warranties. Your use is at your own discretion and subject to those third parties’ terms and policies. We are not responsible for third-party sites or services.

10) Privacy, Cookies & Shopify

Your use of the Services is subject to our Privacy Policy and Cookie Policy. Because our store is hosted by Shopify, certain data is processed by Shopify to provide core e-commerce functionality. Please review:

11) Prohibited Uses

You may not use the Services: (a) for unlawful purposes; (b) to violate laws or third-party rights; (c) to harass, abuse, defame, or harm others; (d) to upload malware or interfere with security; (e) to circumvent quantity limits or attempt reselling; (f) to engage in fraud; (g) to scrape, spider, or crawl without permission; or (h) in any way that impairs others’ use of the Services. We may suspend or terminate access for violations.

12) Feedback & Reviews

If you submit ideas, reviews or feedback (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish and display such Feedback for any purpose. You represent you have the rights to grant this license and that your Feedback complies with these Terms and applicable laws. We may moderate or remove Feedback at our discretion.

13) Errors, Inaccuracies & Availability

From time to time, information on the Services may contain typographical errors, inaccuracies, or omissions (including pricing, availability, and shipping information). We reserve the right to correct, update, or cancel orders affected by such errors, with a full refund where applicable.

14) Warranties – Disclaimer

EXCEPT AS EXPRESSLY STATED BY CACHEMIO OR REQUIRED BY LAW, THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.
Nothing in this Section affects rights that cannot be limited under applicable law (including statutory conformity rights in the EU/UK).

15) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CACHEMIO AND ITS OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS.

To the extent permitted by law, our total liability for any claim relating to a product shall not exceed the amount you paid for that product.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, or for death or personal injury caused by negligence, and only to the extent such limitation is not permitted by law.

16) Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless CacheMio and our affiliates, officers, employees, and agents from any third-party claims, losses, or damages arising from your breach of these Terms or misuse of the Services.

17) Force Majeure

We are not liable for any delay or failure to perform due to events beyond our reasonable control, including acts of God, labor disputes, disruptions of transportation or utilities, war, epidemic, governmental actions, or failures of third-party service providers.

18) Termination & Suspension

We may suspend or terminate your access to the Services at any time, with or without notice, including for suspected fraud, abuse, or violations of these Terms. You remain responsible for amounts due up to the date of termination. Provisions which by their nature should survive termination shall survive (including IP, Feedback, Disclaimers, Limitations of Liability, Indemnification, Severability, Governing Law).

19) Governing Law; Disputes

These Terms and any purchases are governed by the laws of Spain, without regard to conflict-of-law principles. You and CacheMio submit to the exclusive jurisdiction of the courts of Barcelona, Spain.

EU consumers: You may also bring proceedings in your local courts. You may access the EU Online Dispute Resolution platform:

UK consumers: You retain all rights under UK consumer law (including the Consumer Rights Act 2015 and Consumer Contracts Regulations 2013).

20) Severability

If any provision is found unlawful or unenforceable, it will be enforced to the maximum extent permitted and the remainder will remain in full force and effect.

21) Waiver; Entire Agreement; Interpretation

Failure to enforce any right is not a waiver. These Terms, together with policies referenced herein (including Privacy, Cookie, Shipping and Refund Policies), constitute the entire agreement between you and CacheMio regarding the Services and supersede prior agreements.
If we provide these Terms in multiple languages, the English version controls in case of conflict.

22) Assignment

You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations without consent, including to an affiliate or in connection with a merger, acquisition, or sale of assets.

23) Changes to These Terms

We may update these Terms from time to time. The “Last updated” date will reflect the latest version. If we make material changes, we will notify you via site banner and/or email (where appropriate) and indicate the effective date. Your continued use after changes constitutes acceptance.
